LevelPlay Sports Privacy Policy

Thank you for visiting LevelPlay Sports, a digital service presented to you by LevelPlay Sports, Inc. (“LevelPlay Sports” “we” or “us”).  LevelPlay Sports understands your privacy is important and is committed to protecting it. We provide this privacy policy (“Privacy Policy”) to explain how we collect, use, and disclose the information we may collect from you when you (“you” or “User”) use the LevelPlay Sports iOS application called “LevelPlay Sports” (“App”) or visit the LevelPlay Sports website located at www.levelplaysports.com (“Site”). This Privacy Policy is a part of, and is incorporated into the LevelPlay Sports Terms of Use (“Terms”) located at www.levelplaysports.com/tos/. If any provision of this Privacy Policy is inconsistent or conflicts with any provision of the Terms, this Privacy Policy will control with respect to the subject matter of this Privacy Policy.

By visiting or using the App or Site you acknowledge and agree to the terms of this Privacy Policy and you expressly consent to the collection, use and disclosure of your information, including Personal Information (as defined below), in accordance with this Privacy Policy. If you do not agree with the terms of this Privacy Policy, you should immediately cease use of the App and Site.

1. Types of Information. We collect Personal Information and Anonymous Information , each as defined below, in connection with your use of the App and Site. Information that is not Personal Information or Anonymous Information is governed by the Terms.

1.1.         “Personal Information” is information which may be used to identify or contact an individual, such as your precise geo-location information or email address.

1.2.         “Anonymous Information” is information that is not associated with or linked to your Personal Information and which, on its own, does not individually identify you.

2. How We Collect Information . We receive information that is automatically collected from you and information that you share with us.

2.1. Information That is Automatically Collected . We use automated means to collect your device identifier (an Apple UUID) and usage information about how you use the App, including communication data and the resources that you access and use on or through the App.

2.2. Information You May Share . When you access the App you may be asked to share your precise (GPS level) geo-location information with us so we can customize your experience on the App. If you agree to such collection, in some cases, you will be able to turn off geo-location tracking by accessing the privacy settings of your mobile device. When you visit the Site, you may choose to share information including email addresses with LevelPlay Sports.

3. How We Use Your Information. We may use your information to:

• provide and communicate with you about the App, the Site and their contents;
• communicate with you about other products, programs or services that we believe may be of interest to you;
• enforce the legal terms (including without limitation our Privacy Policy and Terms) that govern your use of our App and Site, and/or for the purposes for which you provided the information;
• provide technical support for the App;
• prevent fraud or potentially illegal activities (including, without limitation, copyright infringement) on or through the App;
• customize offers and content made available to you based on your visits to and/or usage of the App and analyze the performance of those offers and content, as well as your interaction with them; and
• perform analysis regarding how you use the App or any part thereof.

4.         Information Sharing and Disclosure

4.1.         We share your information with third party service providers and individuals to administer and provide services on our behalf including, but not limited to: (a) conduct research and analytics; (b) create content; (c) provide customer, technical or operational support; (d) conduct or support marketing (such as email or advertising platforms); (e) respond to User requests; (f) host our App and Site; (h) maintain databases; and (i) otherwise support our App and Site.

4.2.         Regardless of any choices you make regarding your information, we may disclose your Personal Information and Anonymous Information: (a) in response to subpoenas, warrants, court orders, lawful requests, or legal process; (b) in order to investigate, prevent, or take action (in our sole discretion) regarding potentially illegal activities, suspected fraud, situations involving potential threats to any person, us, or the App or Site; (c) in order to investigate violations of our Terms or the law.

4.3.         We may transfer some or all of your information if we, or one of our business units, undergoes a business transition, like a merger, acquisition by another company, or sale of all or part of our assets, or if a substantial portion of our or of a business unit’s assets is sold or merged in this way.

4.4.        We may share Anonymous Information with third parties (e.g., our third party service providers, advertisers, advertising networks and platforms, agencies, and other marketers) that wish to market products or services to you.

5.         Cookies and Tracking Technologies. LevelPlay Sports does not drop cookies. However, we work with third parties who provide offers to you when you visit their websites or mobile applications. These third parties may place a unique cookie on your browser to identify you as a visitor originating from the App.

5.1.         Synching Cookies and Identifiers . We may work with third parties to synchronize unique and anonymous identifiers (such as those associated with cookies) in order to match a third party’s uniquely coded user identifiers to our own.  We may do this, for instance, to enable us or others to send offers that are more relevant, match Users to their likely product interests, and identify Users as having originated from the App.

6. Children Under the Age of 13 .  Our App and Site are not intended for children under 13 years of age. No one under age 13 may provide any Personal Information to the App or Site. We do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on the App or Site and make any purchases through the App. If we learn we have collected or received Personal Information from a child under 13, we will delete that information. 7. Third Party Content .  Please note that the App may contain links to content on third party websites and platforms controlled by third parties. When you visit these third party websites or platforms, they may obtain information from their visitors.  The terms of this Privacy Policy do not apply to these third parties. We have no control over these third parties' use of this information, which is subject to their own privacy policy.

8. How We Respond to Do Not Track Signals . At this time LevelPlay Sports does not recognize automated browser signals regarding tracking mechanisms, which may include “do not track” instructions.

9. Data Security. We have put in place physical, electronic, and managerial procedures designed to help prevent unauthorized access, to maintain data security, and to correctly use the information we collect online. These safeguards vary based on the sensitivity of the information that we collect and store. Although we take appropriate measures to safeguard against unauthorized disclosures of Information, we cannot assure you that Information will never be disclosed, altered or destroyed in a manner that is inconsistent with this Privacy Policy.

10.          Updates & Effective Date

From time to time, we may update this Privacy Policy.  We will notify you about material changes by prominently posting a notice on our platform.  We encourage you to periodically check back and review these terms so that you always will know what information we collect, how we use it, and with whom we share it.
